Keith Dromm on Sexual Harassment | Broadview Press Publisher's ...

Keith Dromm, Associate Professor of Philosophy at Louisiana Scholars? College at Northwestern University and author of the recently published Sexual Harassment: An Introduction to the Conceptual and Ethical Issues, sat down with Alex Sager, Acquiring Editor for the Broadview Guides to Business and Professional Ethics series, to answer a few questions on the corporate, legal, and philosophical issues surrounding sexual harassment.

Interview with Keith Dromm:

1. The title of your book is Sexual Harassment: An Introduction to the Conceptual and Ethical Issues. What makes sexual harassment a conceptual issue?

Before we can try to prevent sexual harassment we need to understand what it is. For example, without a good understanding, we might try to prevent actions that are not sexual harassment?or even illegal or wrong in some other way?or fail to prevent actions that are sexual harassment. Unfortunately, a single, stable definition of sexual harassment is elusive. Part of the challenge of defining sexual harassment occurs because there are three different sources of definitions: legal, descriptive, and normative.

The legal understanding of sexual harassment arises from a number of lawsuits in the 1970s. It was during this period that a single term emerged for describing the various behaviors that constitute it and that they became illegal. As I discuss below, in the United States this litigation led to an understanding of sexual harassment based on anti-discrimination law.

Descriptive definitions simply record how the term is typically used in society. Though they are influenced by law, they often differ from legal definitions in important respects. For example, many people would consider it sexual harassment to yell sexually suggestive comments to passing strangers even if it might not legally constitute sexual harassment.

Both legal and descriptive definitions might ignore some actions that ought to constitute sexual harassment. We thus need a normative definition of sexual harassment that tells us what is wrong about it. Normative definitions may then be used to criticize legal and descriptive definitions. Since moral theorists disagree about the nature of sexual harassment, one of my goals in the book is to argue for a ?core? definition that contains the common and essential elements of different legal, descriptive, and normative definitions. According to this definition, sexual harassment is unwelcome behavior of a sexual nature, and the persons responsible for this behavior have power over its target.

A definition of sexual harassment can allow us to answer other important conceptual questions related to sexual harassment, such as those that serve as the titles to two of the book?s other chapters, ?Where can sexual harassment occur?? and ?How can sexual harassment occur?? These chapters examine, respectively, the contexts in which sexual harassment can take place and the behaviors, sometimes subtle or in other ways difficult to recognize, that can constitute sexual harassment. Only a good grasp of the concept of sexual harassment can allow us to answer these and similar questions.

2. You are critical of sexual harassment law, particularly in the United States where it is considered to be an issue of sex discrimination. In your view, is discrimination the primary issue in sexual harassment? What alternative legal frameworks exist? What recommendations would you have to a country that is drafting new sexual harassment legislation?

Sexual harassment law in the United States arises out of anti-discrimination law; there is no federal law that specifically targets the behaviors that constitute sexual harassment. The law reflects the recognition that sexual harassment can be used as a tool of discrimination, one that has been wielded primarily against women to limit their opportunities in employment and education. One problem, however, is that not all cases of sexual harassment are cases of discrimination. The most notorious example is the so-called ?equal-opportunity harasser,? someone who harasses men and women equally, so doesn?t discriminate in his or her harassment. The victims of these forms of sexual harassment are harmed, but not because they are discriminated against. There is harm, for one thing, to their dignity. But there is little legal protection against such harms.

It is important to recognize, both conceptually and legally, how sexual harassment can be a form of discrimination. However, workers have the right to be protected from other forms of sexual harassment. I discuss in my book various alternative legal approaches but do not come out strongly in favor of any one of them. They all involve separating sexual harassment law from anti-discrimination law, although without necessarily abandoning the latter. We still need laws to protect us from discrimination. Protection from other forms of sexual harassment might not need new laws directed specifically at them. Laws that grant greater overall protection to workers might be sufficient. For example, in the United States, the employment relationship is governed by the at-will doctrine, which allows employees to be fired without just cause. I endorse the view of many legal scholars and others that the at-will doctrine weakens the power of workers, including making them less able to resist sexual harassment. Abandoning or relaxing the doctrine would grant greater protection to workers against all forms of harassment.

It is also important to recognize that the law is not an effective or otherwise appropriate remedy for all forms of sexual harassment. It also cannot provide a complete solution to sexual harassment. Sexual harassment is caused by beliefs about the worth and dignity of individuals and groups of people that cannot be modified by the law alone. Deeper cultural changes are required to change these beliefs. One of these changes, of course, is affording equal opportunities to women in our workplaces and schools by eliminating discrimination.

3. You state in your introduction that many employees resent sexual harassment training and that it is often poorly implemented. What thoughts do you have on how to make sexual harassment training more effective?

I?d like to see some research that attempts to explain the negative attitude employees have towards sexual harassment training, but I suspect that many simply find it insulting. Training of any sort implies some sort of deficiency, but there are some deficiencies we?re more willing to admit to than others. If a company implements new software or machinery, most employees would willingly admit their ignorance about it and gladly accept training to help them use it. Training in sexual harassment, however, implies that a person?s social skills need to be improved. Most people are reluctant to admit to this and would understandably resist training on how to behave better towards others (even though many of these people might need this sort of training). More effective training would attempt to deemphasize, if not eliminate, this implication. One way to do this would be to make the training interactive. Rather than being ?lectured to? by speakers or videos about how to treat others, the training could involve soliciting from employees their ideas about how to reduce sexual harassment in the workplace. It would draw on the employees? own expertise on how to treat others, rather than presupposing that they need some training in this. Some of the ideas generated in these sessions could even be incorporated into the workplace?s sexual harassment policy. Research has shown that interactive training is more likely to change positively the behavior and attitudes of trainees. It can also improve employees? attitudes towards training by getting rid of the implication that their interpersonal skills need to be improved. To go along with this, it would probably be helpful if the word ?training? were dropped and replaced with something like ?workshop.?

There are other problems with sexual harassment training. For example, many workplaces institute training in order to comply with state laws or as a protection against lawsuits. Research has shown that when these are its only motivations, the training tends to be less effective in reducing incidences of sexual harassment. So, the training should be guided by a sincere concern to reduce sexual harassment. I discuss more ideas for improving sexual harassment training in the final chapter of my book, ?How to Prevent Sexual Harassment.?

4. Vicki Schultz has argued that sexual harassment policies often lead to a ?sanitized workplace? in which employers prohibit sexuality in the workplace even if it is benign or positive. Do you share Schultz?s concern and do you think there are ways of implementing sexual harassment policies that avoid her objections?

Schultz believes that sexual harassment law could be used by employers as an excuse to more tightly control employees? behavior. She is concerned particularly about prohibitions on romantic or sexual relationships between employees or the use of so-called ?love contracts? that require workers to acknowledge their consent before entering such relationships. While the ostensible goal of such policies is the prevention of sexual harassment, they inhibit the development of both sexual and non-sexual consensual relationships between employees. Given the amount of time that employees spend at work, the workplace is for many of them a primary source of social relationships. So, these policies will have deleterious consequences on their social lives. These are legitimate concerns. Schultz correctly observes that it impossible to eradicate sexuality entirely from the workplace and the result of policies that control employees? interpersonal relationships will only be increased surveillance of workers? behavior. The workers might also develop a negative attitude generally towards efforts to combat sexual harassment because of policies like these. Nevertheless, there remains a need for sexual harassment policies in workplaces. When properly designed, they can protect both employers and employees. The policies need to be targeted towards the behaviors that can constitute sexual harassment and the relationships in which it can occur. Policies that prohibit or tightly regulate all sexual or romantic relationships in a workplace are overkill and will have those negative consequences about which Schultz warns.

5. Much of your teaching and writing explores topics in popular culture?in fact, your earlier published work on sexual harassment appeared in The Office and Philosophy. You?ve also contributed articles to a number of collections on philosophy and popular topics such as the television show The X-Files, the film Inception, and the films of Steven Spielberg. What led you to regularly contribute to books aimed at the general reader?

Philosophy books aimed at the general reader are valuable. They can introduce a wider audience to philosophy than more academic books, which is important since there are decreasing opportunities to study philosophy in schools. Such books are also capable of demonstrating the relevance of philosophy. They can show that philosophy has something to say even about, for example, popular culture, as well as the problems?sometimes fantastical, but also often ordinary?that are the subjects of popular culture (my book includes an appendix of popular films and television shows that deal with sexual harassment).

I have the same aspirations for my book. It is written for a general audience. But like the books I?ve contributed to, its purpose is not to instruct readers about philosophy. Instead, it uses philosophy to help clarify and in other ways illuminate its topic. It hopefully demonstrates how philosophy can be used to increase our understanding of sexual harassment, and how this understanding is essential to our efforts to reduce it.

ScienceDaily (May 29, 2012) ? New research from the University of Warwick could explain why the evil eyebrows and pointy chin of a cartoon villain make our 'threat' instinct kick in.

Psychologists have found that a downward pointing triangle can be perceived to carry threat just like a negative face in a crowd.

In a paper published in Emotion, a journal of the American Psychological Association, Dr Derrick Watson and Dr Elisabeth Blagrove have carried out a series of experiments with volunteers to find out if simple geometric shapes can convey positive or negative emotions.

Previous research by these scientists showed that people could pick out a negative face in a crowd more quickly than a positive or neutral face and also that it was difficult to ignore faces in general. The researchers carried out a series of experiments asking volunteers to respond to computer-generated images. They were shown positive, negative and neutral faces, and triangles facing upwards, downwards, inward and outward. This latest study shows that downward triangles are detected just as quickly as a negative face.

Dr Watson said: "We know from previous studies that simple geometric shapes are effective at capturing or guiding attention, particularly if these shapes carry the features present within negative or positive faces."

"Our study shows that downward pointing triangles in particular convey negative emotions and we can pick up on them quickly and perceive them as a threat."

Dr Blagrove added: "If we look at cartoon characters, the classic baddie will often be drawn with the evil eyebrows that come to a downward point in the middle. This could go some way to explain why we associate the downward pointing triangle with negative faces. These shapes correspond with our own facial features and we are unconsciously making that link."

Japan minister visits nuke plant amid safety worry

TOKYO (AP) - Japan's environment and nuclear minister visited the tsunami-crippled Fukushima Dai-ichi nuclear power plant on Saturday to inspect a spent fuel pool at the center of safety concerns and said it appeared to have been properly reinforced.

The visit by Goshi Hosono, apparently aimed at demonstrating the safety of the facility, came amid renewed concerns about conditions at the plant's No. 4 reactor after its operator reported a bulging of the building's wall. Nuclear regulators ordered a new investigation and seismic tests of the building and its pool.

The building was damaged by an explosion and fire soon after the Fukushima plant was hit by a massive magnitude-9.0 earthquake and tsunami on March 11, 2011. The pool, located at the top of the building above the reactor, remains one of the plant's biggest risks due to its vulnerability to earthquakes.

The plant's operator, Tokyo Electric Power Co., has reinforced the structure and says it now can withstand temblors as strong as last year's quake.

A small group of journalists was allowed to enter the reactor building for the first time with Hosono. Inside were piles of broken wall panels, pieces of cement and mangled equipment, showing the magnitude of the explosion.

Hosono, wearing protective coveralls and a full-face mask, climbed a narrow makeshift staircase to the fifth floor to see the pool, which was covered with a protective tarp. TEPCO officials lifted part of the cover to show the water surface.

He said he was not able to see the newly found 3 centimeter (1 inch) outward bulge in the building's wall with his own eyes, but urged TEPCO "not to take an optimistic view and instead deal with it carefully in order to ensure safety."

Hosono later told reporters that he could see that the pool had been sufficiently reinforced.

"I could see steady progress being made toward removal of the spent fuel (from the pool), which is the next major goal," he said.

The fuel rods in the storage pool are not enclosed as they are in reactor cores and could cause a greater release of radiation in case of a loss of water.

TEPCO is preparing to move the fuel rods from the pool to a joint pool for all six reactors next to the building, but the process won't start until late next year. The joint pool is located on the ground level and is considered safer, even though it already has 6,000 fuel rods in it, officials said. It is expected to take 40 years to decommission the reactors.

Akio Komori, one of the TEPCO executives who escorted Hosono, said the company will inspect the No. 4 building to ensure its integrity while continuing with the fuel removal. Komori, however, rejected growing calls to allow outside experts to inspect the plant's safety.

"As the party with direct responsibility, it's our job to carry out the necessary checks," he said.

From early on, experts have raised concerns about the pool at the No. 4 reactor, where 1,535 fuel rods - the most of any of Fukushima's six reactors - were stored because the reactor was undergoing major refurbishing and the fuel ordinarily inside its core was also kept in the pool.

U.S. nuclear officials feared the fuel rods would overheat and melt as water evaporated from the pool.

The pool had enough water to cover the rods, but officials recently said they might have been saved by chance.

When the disaster struck, two additional pools next to the fuel storage pool had been temporarily filled with water to store equipment used during the refurbishing. That water flowed into the fuel rod pool as its water level declined, though it's not clear whether the rods would have been exposed otherwise, Nuclear and Industrial Safety Agency official Masaru Kobayashi said.

A worst-case scenario envisioned by the head of the Japan Atomic Energy Commission two weeks after last year's accident warned that a melting of the fuel rods at the No. 4 reactor would require the evacuation of 30 million people just from the greater Tokyo area.

Vegas grocer accused of war crimes sent to Bosnia

A man accused of commanding a police squad that rounded up Bosnian Muslims for slaughter in 1995 fashioned a new life in Las Vegas as a modest grocery store owner before being arrested and deported to his native country, a lawyer and U.S. officials said Thursday.

Dejan Radojkovic arrived in Sarajevo, Bosnia-Herzegovina, after an overnight commercial airline flight from Las Vegas accompanied by federal agents, Bosnian authorities and U.S. Immigration and Customs Enforcement officials said.

Radojkovic's lawyer in Las Vegas, Don Chairez, denied that any evidence links the 61-year-old man ? a permanent U.S. resident and father of two ? with the execution of Muslim boys and men in an event considered Europe's bloodiest mass killing since World War II.

"He is not a war criminal," Chairez told The Associated Press. "There is no evidence that Mr. Radojkovic ever killed anybody."

Prosecutors allege Radojkovic commanded a special police brigade that rounded up about 200 Muslim men in July 1995 in the Konjevic Polje region for execution, an Immigration and Customs Enforcement statement said.

Chairez said Radojkovic's national guard unit accepted the surrender of about 200 enemy soldiers and turned them over to Bosnian Serb forces. Chairez said Radojkovic didn't know the men would be killed.

Radojkovic was arrested in January 2009 for failing to disclose his wartime history when he entered the U.S. as an ethnic Serbian refugee, said Nicole Navas, an Immigration and Customs Enforcement spokeswoman in Washington, D.C. An immigration judge in late 2009 ordered him deported on multiple grounds, finding that he ordered or participated in "extrajudicial killing."

Court documents show Radojkovic was accused of failing to report that he had been a squad commander in the Republika Srpska Special Police Squad.

U.S. and Bosnian authorities said Radojkovic was handed over Thursday to police at the Sarajevo airport for prosecution based on evidence collected by investigators from the ICE Human Rights Violators and War Crimes Center, the International Criminal Tribunal for the Former Yugoslavia at The Hague and prosecutors from Bosnia-Herzegovina.

"He's wanted on genocide charges," Navas said.

"For the families who lost loved ones at Srebrenica, justice has been a long time coming," Immigration and Customs Enforcement Director John Morton said in a statement announcing Radojkovic's deportation. "But they can take consolation in the fact that those responsible for this tragedy are now being held accountable."

Morton promised to ensure the U.S. "does not serve as a haven for human rights violators and others who have committed heinous acts."

The Immigration and Customs chief also pointed to the January 2010 deportation to Bosnia-Herzegovina of Nedjo Ikonic, a Milwaukee, Wis., resident identified as another former special police commander linked to the Srebrenica massacre.

Ikonic was Radojkovic's police commander, Navas said.

Authorities preparing for the trial of former Bosnian Serb military leader Ratko Mladic on war crimes charges at The Hague, Netherlands, said this month the remains of almost 6,000 people had been exhumed from mass graves in the Srebrenica area. Estimates of the dead run as high as 8,000.

Mladic is standing trial before the military war tribunal on wider charges stemming from atrocities during a process dubbed "ethnic cleansing." Bosnia's 1992-95 war following the breakup of the former Soviet republic of Yugoslavia left more than 100,000 dead.

Court documents show Radojkovic and his family were granted refugee status and admitted to the United States in June 1999. Radojkovic's wife, Radojka Radojkovic, died in a car crash in Las Vegas in September 2000. A newspaper obituary said she was 43.

Radojkovic's daughter, Ranka Shaw, divorced and moved last year to Bosnia, Chairez said. A son, Ranko Radojkovic, lives in Las Vegas. Neither immediately responded to messages through Chairez.

Radojkovic became a permanent U.S. resident in January 2002. Chairez said Radojkovic used money from an insurance settlement following the crash to open the grocery, which sold food, tobacco, sundries and videos. The business closed after Radojkovic was arrested in January 2009. He remained in U.S. custody for more than three years.

Chairez said Radojkovic had been a police dog trainer in Sarajevo before the breakup of Yugoslavia and was drafted by the Bosnian Serbian military after the war began.

Radojkovic testified in Milwaukee against Ikonic, who Chairez said commanded three police units, including Radojkovic's.

"The government merely alleges that as an individual who was part of a group that accepted the surrender of these enemy soldiers, it is presumed that Radojkovic should have known that the Bosnian-Serbian military forces were likely to kill them," Chairez protested in an appeal to the 9th U.S. Circuit Court of Appeals in San Francisco.

The Muslim soldiers were loaded on buses and driven away, the lawyer said. "There is no evidence and there is no allegation that Radojkovic shot and killed a single prisoner."

The appeals court in February denied Chairez's appeal, clearing the way for Radojkovic's deportation.

Light-bulb-innovationContinuous innovation is required to survive in all businesses, beginning with a startup, and increasing in importance as your business matures. Technologists often insist that new things can?t be invented on a schedule, but successful companies seem to be able to do it on a regular basis.

Many people have tried to define a process for innovation, but most are too abstract for me. I like the easy to remember approach found in ?Robert?s Rules of Innovation: A 10-Step Program for Corporate Survival,? by Robert F. Brands. It seems to be more concrete, and chronicles several decades of practical experience to solidify the principles which together spell INNOVATION:

  1. Inspire. The first and most important step is to identify a leader who can inspire and drive the process. In a startup, that needs to be the founder or CEO, and that person has to be regularly and personally involved. This is an imperative.

  2. No risk, no innovation. Not every idea can, or will, be a winner. Without risk, there can be no innovation. Innovation teams perform best when they trust that failure or a pivot will not result in punitive measures. Fear of failure can kill innovation.

  3. New product development process. A formalized process with timelines and milestones is a must. This should include at least the key elements of idea generation, prioritization, prototyping, commercialization, and measurement.

  4. Ownership. Innovation needs ownership, a champion and team leader within the organization. The champion must have the credibility to convince others to take calculated risks and work outside of one?s comfort zone.

  5. Value creation. Successful innovation turns ideas into money, to enhance customer value, and thus shareholder value. Longer-term, enhanced product value begets superior company valuation through your organization?s intellectual property (IP) portfolio.

  6. Accountability. This is a critical component of the trust equation, even when the process is akin to ?herding cats.? Team members need to feel responsibility for on-time delivery. Slippage is the sure way to jeopardize the entire process.

  7. Training and coaching. Proper hiring of people with a natural curiosity, open-mindedness, and ability to see the big picture is the way to create and enhance the right mind-set. Ongoing coaching from the top is essential to maintain the attitude and spirit.

  8. Idea management. Build and manage a pipeline of ideas. From time to time, include customers and sales members in ideation sessions. Make sure all team members have some connection with the product ? has either used it, or sold it, or assembled it.

  9. Observe and measure. Tracking results are essential to optimal ROI. Product life cycles keep getting shorter and shorter, which mandates accelerated innovation cycles. Once a new product is launched, a key metric is the ratio of new product sales to overall sales.

  10. Net result and reward. Based on ROI, incentives should be developed for all participants. Reward your people. Frequently, the key motivator is less financial than it is recognition for a job well done. People are your best innovation resource.

Sustainable innovation is really the only sustainable competitive advantage. But innovation is hard, because people by nature resist change, and company cultures are most comfortable with status quo. Yet survival in today?s world of rapid business change requires that you keep one step ahead of your competition. Innovation is what gives life to your business initially, and keeps it alive in the long term. Make sure your business can spell it.

Exotic particles, chilled and trapped, form giant matter wave

ScienceDaily (May 24, 2012) ? Physicists have trapped and cooled exotic particles called excitons so effectively that they condensed and cohered to form a giant matter wave.

This feat will allow scientists to better study the physical properties of excitons, which exist only fleetingly yet offer promising applications as diverse as efficient harvesting of solar energy and ultrafast computing.

"The realization of the exciton condensate in a trap opens the opportunity to study this interesting state. Traps allow control of the condensate, providing a new way to study fundamental properties of light and matter," said Leonid Butov, professor of physics at the University of California, San Diego. A paper reporting his team's success was recently published in the scientific journal Nano Letters.

Excitons are composite particles made up of an electron and a "hole" left by a missing electron in a semiconductor. Created by light, these coupled pairs exist in nature. The formation and dynamics of excitons play a critical role in photosynthesis, for example.

Like other matter, excitons have a dual nature of both particle and wave, in a quantum mechanical view. The waves are usually unsynchronized, but when particles are cooled enough to condense, their waves synchronize and combine to form a giant matter wave, a state that others have observed for atoms.

Scientists can easily create excitons by shining light on a semiconductor, but in order for the excitons to condense they must be chilled before they recombine.

The key to the team's success was to separate the electrons far enough from their holes so that excitons could last long enough for the scientists to cool them into a condensate. They accomplished this by creating structures called "coupled quantum wells" that separate electrons from holes in different layers of alloys made of gallium, arsenic and aluminum.

Then they set an electrostatic trap made by a diamond-shaped electrode and chilled their special semiconducting material in an optical dilution refrigerator to as cold as 50 milli-Kelvin, just a fraction of a degree above absolute zero.

A laser focused on the surface of the material created excitons, which began to accumulate at the bottom of the trap as they cooled. Below 1 Kelvin, the entire cloud of excitons cohered to form a single matter wave, a signature of a state called a Bose-Einstein condensate.

Other scientists have seen whole atoms do this when confined in a trap and cooled, but this is the first time that scientists have seen subatomic particles form coherent matter waves in a trap.

Varying the size and depth of the trap will alter the coherent exciton state, providing this team, and others, the opportunity to study the properties of light and mater in a new way.

This most recent discovery stems from an ongoing collaboration between Leonid Butov's research group in UC San Diego's Division of Physical Sciences, including Alexander High, Jason Leonard and Mikas Remeika, and Micah Hanson and Arthur Gossard in UC Santa Barbara's Materials Department. The Army Research Office and the National Science Foundation funded the experiments, and the Department of Energy supported the development of spectroscopy in the optical dilution refrigerator, the technique used to observe the exciton condensate in a trap.
